1. Agreement to Terms

By booking a trip with King Trout Outfitters or using our website, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms apply to all services provided by King Trout Outfitters, including but not limited to guided fishing trips, instruction, equipment rental, and related services.

2. Service Description

King Trout Outfitters provides guided fly fishing services exclusively on the Bow River system in Alberta, Canada, including:

  • Full-Day Float Trips: 8-hour guided fishing experiences ($650 CAD)
  • Half-Day Adventures: 4-hour guided fishing experiences ($475 CAD)
  • Multi-Day Packages: 3-day comprehensive Bow River experiences ($1,950 CAD)
  • Equipment Provision: Professional fly fishing equipment and instruction
  • Safety Services: Professional guiding and safety management

3. Booking & Payment Policies

Booking Requirements

  • All bookings must be confirmed with a deposit of 50% of trip cost
  • Remaining balance due 48 hours before trip departure
  • Valid photo identification required for all participants
  • Participants under 18 require parental/guardian consent
  • Maximum group size of 4 anglers per guide for safety

Payment Terms

  • All prices are in Canadian Dollars (CAD) and include applicable taxes
  • Payment accepted via credit card, e-transfer, or cash
  • Credit card payments subject to processing fees
  • Prices subject to change with 30 days notice

What's Included

  • Professional guide services and instruction
  • All fly fishing equipment (rods, reels, flies, leaders, tippet)
  • Lunch and beverages (full-day trips)
  • Snacks and beverages (half-day trips)
  • Transportation during the trip
  • Fish photography and handling instruction
  • Calgary hotel pickup available (additional fee may apply)

4. Cancellation & Refund Policy

Client Cancellations

  • More than 14 days: Full refund minus $50 CAD processing fee
  • 7-14 days: 75% refund
  • 3-7 days: 50% refund
  • Less than 3 days: No refund unless rescheduled
  • No-shows: No refund

Weather Cancellations

King Trout Outfitters reserves the right to cancel trips due to unsafe weather conditions, including:

  • Lightning or severe thunderstorms
  • Dangerous wind conditions (sustained winds over 40 km/h)
  • Extreme cold or heat that poses safety risks
  • Flooding or hazardous water conditions

Weather Guarantee: If we cancel due to weather, you receive:

  • Full refund OR
  • Reschedule at no additional cost OR
  • Credit toward future trip within 12 months

5. Participant Requirements & Safety

Age & Physical Requirements

  • Minimum age 8 years (with parent/guardian)
  • Participants must be able to walk on uneven terrain
  • Reasonable physical fitness required for boat boarding
  • Pre-existing medical conditions must be disclosed
  • Swimming ability recommended but not required

Safety Requirements

  • Personal flotation devices (PFDs) must be worn as directed
  • Participants must follow all guide instructions
  • Alcohol consumption prohibited during trips
  • Illegal drug use strictly prohibited
  • Appropriate clothing and footwear required

What to Bring

  • Valid fishing license (available online or from retailers)
  • Weather-appropriate clothing
  • Sun protection (hat, sunglasses, sunscreen)
  • Personal medications
  • Camera for memorable moments

6. Liability & Risk Acknowledgment

IMPORTANT: READ CAREFULLY

Fishing and outdoor activities involve inherent risks. By participating, you acknowledge these risks and agree to our liability limitations.

Assumption of Risk

You acknowledge that fishing trips involve risks including but not limited to:

  • Injury from fishing equipment (hooks, lines, rods)
  • Slip, trip, and fall hazards on boats and shorelines
  • Weather-related risks and exposure
  • Water-related risks including drowning
  • Wildlife encounters
  • Equipment malfunction or failure

Limitation of Liability

King Trout Outfitters' liability is limited to the amount paid for services. We are not liable for:

  • Personal injury or property damage
  • Indirect, consequential, or punitive damages
  • Acts of nature, weather, or unforeseeable circumstances
  • Third-party actions or negligence
  • Pre-existing medical conditions

7. Equipment & Property

Provided Equipment

  • All equipment remains property of King Trout Outfitters
  • Participants responsible for reasonable care of equipment
  • Damaged or lost equipment may incur replacement charges
  • Equipment must be returned at trip conclusion

Personal Property

  • Participants responsible for personal belongings
  • King Trout Outfitters not liable for lost, stolen, or damaged personal items
  • Waterproof storage recommended for valuables
  • Insurance claims are participant's responsibility

8. Conduct & Behavior Policy

Expected Behavior

  • Respectful treatment of guides, other participants, and wildlife
  • Compliance with all applicable laws and regulations
  • Proper catch and release practices
  • Environmental stewardship and Leave No Trace principles
  • Punctuality and preparedness

Prohibited Behavior

The following behaviors may result in immediate trip termination without refund:

  • Intoxication or substance abuse
  • Aggressive, threatening, or abusive behavior
  • Harassment of any kind
  • Willful damage to equipment or property
  • Refusal to follow safety instructions
  • Illegal activities of any kind

9. Fishing Regulations & Conservation

License Requirements

  • Valid Alberta fishing license required for all participants
  • Participants responsible for obtaining proper licenses
  • License violations are participant's responsibility
  • King Trout Outfitters may assist with license information but not responsible for compliance

Conservation Practices

  • Catch and release mandatory for all trout species
  • Proper fish handling techniques required
  • Barbless hooks mandatory
  • No fish retention allowed
  • Compliance with all Alberta fishing regulations

10. Photography & Media Release

By participating in our trips, you grant King Trout Outfitters permission to:

  • Photograph and video record your participation
  • Use images for marketing, promotional, and educational purposes
  • Share content on websites, social media, and marketing materials
  • Use testimonials and reviews in promotional content

You may opt-out of photography by informing your guide at trip start. Personal photography is encouraged and welcomed.

11. Force Majeure

King Trout Outfitters is not liable for inability to provide services due to circumstances beyond our control, including:

  • Natural disasters, floods, or extreme weather
  • Government regulations or restrictions
  • Public health emergencies
  • Labor disputes or transportation disruptions
  • Equipment failure beyond our control
  • River closures or access restrictions

12. Governing Law & Dispute Resolution

These terms are governed by the laws of Alberta, Canada. Any disputes will be resolved through:

  1. Direct Communication: Good faith efforts to resolve disputes directly
  2. Mediation: Binding mediation in Calgary, Alberta
  3. Legal Action: Courts of Alberta (as last resort)
